Welcome to DAYWORK. By creating an account or using our platform, you agree to these Terms of Service. Please read them carefully before using GoDayWork.

1. Eligibility

You must be at least 18 years of age to use GoDayWork. By using this platform, you confirm that you are 18 or older. We do not knowingly allow minors to create accounts. If we learn that a user is under 18, we will terminate their account immediately.

2. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You must provide your real first and last name when creating your account — usernames are not permitted
• You may not share your account with others or create multiple accounts
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• Accounts that are deleted by an administrator may not be re-registered using the same email address

3. Identity Verification & Profile Requirements

Step 1 — Name Approval

When you create an account, you must enter your real first and last legal name. Your name is submitted to a GoDayWork administrator for review before you can access any platform features. Until your name is approved, you will see a holding screen and cannot browse, post, or apply for jobs.

If your name is rejected (for example, if it does not appear to be a real legal name), your account will be removed and you will be notified to sign up again with your correct name.

Step 2 — Profile Verification

Once your name is approved, you must complete your profile with the following before posting or applying for jobs:

• Full Legal Name — Already submitted at signup. You may update it via Account Settings, which will require re-approval.
• Phone Number — A valid, working 10-digit U.S. phone number where you can be reached.
• Profile Photo — A clear, recent photo of your face. Photos must show the account holder and may not be logos, cartoons, or images of other people. A profile photo is required for your account to be approved.

By submitting this information, you confirm that it is accurate and truthful. Providing false identity information is a violation of these Terms and may result in immediate account termination.

Manual Review: All submitted profiles — including names and photos — are manually reviewed and approved by a GoDayWork administrator. Until fully approved, you will not be able to post jobs or apply for jobs. You will be notified when your profile is approved or rejected. If rejected, you will be told the specific reason (photo or name) and may resubmit.

Admin Communications: GoDayWork administrators may send you direct in-app messages regarding your account, profile status, or platform updates. These messages appear in your notification bell and are stored in your account.

Name Display & Privacy: Your full legal name is stored securely and is never shown publicly. On job listings, applicant lists, and all public-facing areas of the platform, your name is displayed in a privacy-protected format showing only your first name and last initial (for example, "Jane S."). Your full identity details are accessible only to GoDayWork administrators.

4. Law Enforcement Disclosure

GoDayWork maintains identity records (full legal name, phone number, and profile photo) for all verified users. GoDayWork will share user identity information — including full name, phone number, profile photo, and account activity — with law enforcement agencies when legally required to do so, including but not limited to:

• Valid court orders, subpoenas, or search warrants
• Requests from law enforcement investigating a crime that occurred at a job arranged through the platform
• Situations involving an immediate threat to the safety of any person
• Reports of content involving minors (zero-tolerance — always reported immediately)

By creating an account and completing your profile, you acknowledge and consent to this law enforcement disclosure policy. If you do not agree, you may not use GoDayWork's posting or application features.

5. Platform Use

Job Hirers

• You may post same-day job listings that are legal, honest, and accurately described
• You must honor the pay amount stated in your job listing
• You are responsible for paying workers through the Stripe payment system
• Job listings expire after 24 hours unless extended
• You may not post jobs that involve illegal activities, harassment, or discrimination

Job Seekers (Workers)

• You may apply to jobs that match your skills and availability
• You must show up and complete jobs you are hired for, or cancel in advance
• You are responsible for the quality and completion of your work
• You may not misrepresent your skills or experience in your profile

Workers Available

The Workers Available tab allows workers to post their availability and receive price offers from hirers.

• Availability posts are visible to all users and expire after 24 hours
• Workers may accept or reject any offer — no obligation exists until acceptance
• Once an offer is accepted, both parties are expected to follow through on the agreed terms
• Hirers may submit one price offer per availability post; repeated low-ball or bad-faith offers are prohibited
• Chat between a worker and hirer only opens after an offer is accepted
• All payments for accepted offers must be processed through the GoDayWork platform

6. Payments

Platform Fee

GoDayWork charges a 7% platform fee on all job payments. This fee is added on top of the job pay amount and is charged to the hirer at checkout. The platform fee is non-refundable once payment has been processed.

Example: If a job pays $100, the hirer will be charged $107 at checkout ($100 job payment + $7 platform fee). The worker receives payment for the agreed job amount.

Tips

Hirers may optionally add a tip for their worker at the time of payment. Tips are passed 100% to the worker — no platform fee is charged on tips. Tips are voluntary and not required. Once a tip is processed through Stripe, it is non-refundable.

Payment Processing

• All payments are processed in US Dollars (USD)
• Payment is collected from the hirer via Stripe Checkout at the time of payment
• Workers receive payment as arranged — GoDayWork facilitates the transaction
• A minimum payment of $0.50 is required by Stripe
• Maximum payment per job is $200. Job listings may not exceed this amount.
• GoDayWork is not responsible for payment disputes between hirers and workers beyond facilitating the transaction

Payment Types

When posting a job, hirers select one of the following payment structures:

• Flat Rate — A fixed total amount paid to the worker upon job completion, regardless of time worked.
• Per Hour — An hourly rate agreed upon at time of posting. The total payment collected at checkout is based on the stated hourly rate. GoDayWork does not track hours — it is the responsibility of the hirer and worker to agree on total hours worked.

Worker Payouts

Once a hirer marks a job as complete, the payment is released to the worker's connected Stripe account. Workers can choose how to receive their funds:

• Standard Payout (Free) — Funds are deposited to your bank account within approximately 2 business days at no charge.
• Instant Payout (1% fee, minimum $0.50) — Funds are sent to an eligible debit card within approximately 30 minutes. A 1% instant transfer fee (minimum $0.50) is deducted from your payout amount. Not all debit cards support instant payouts — eligibility is determined by Stripe.

Workers must connect a Stripe payout account via Settings to receive funds. GoDayWork is not responsible for delays caused by Stripe's processing times or bank processing times.

Refunds

Refund requests must be submitted within 48 hours of payment. To request a refund, use the refund request option in the app — you do not need to contact us by email. Refunds are reviewed by our team and, if approved, are processed automatically through Stripe directly back to the original payment method. You will not need to take any further action once a refund is approved.

• The platform fee (7%) is non-refundable once payment has been processed
• Tips are non-refundable once processed through Stripe
• Refund decisions are made at the sole discretion of GoDayWork
• Approved refunds typically appear on your statement within 5–10 business days depending on your bank

7. Prohibited Conduct

You may not use GoDayWork to:

• Post fraudulent, misleading, or illegal job listings
• Harass, threaten, or discriminate against other users
• Arrange payments outside of the GoDayWork platform to avoid fees
• Create fake accounts or impersonate others
• Spam other users or post duplicate listings
• Use the platform for any illegal purpose
• Attempt to hack, scrape, or disrupt the platform

Prohibited Content

The following types of content are strictly prohibited anywhere on GoDayWork — including job listings, worker availability posts, bulletin board posts, chat messages, and profile information:

• Sexual content — Any explicit, pornographic, or sexually suggestive material
• Content involving minors — Any content that sexualizes, exploits, or endangers individuals under 18 years of age. This is a zero-tolerance policy and will be reported to authorities
• Hate speech — Content that attacks or demeans individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Violence & threats — Threats of harm, content that glorifies or incites violence, or descriptions of graphic violence
• Fraud & deception — False job offers, impersonation of other users or businesses, phishing attempts, or any scheme intended to deceive users
• Spam — Repetitive, automated, or irrelevant posts intended to flood the platform or solicit users outside the platform
• Personal information (doxxing) — Posting another person's private information — including address, phone number, financial details, or identification — without their consent

Our platform uses automated word filtering to detect and block prohibited content. Violations may result in immediate account suspension or permanent ban without notice or refund. Serious violations (such as content involving minors) will be reported to law enforcement.

8. Ratings & Reviews

After a job is completed, both the hirer and the worker are required to rate each other. GoDayWork uses a blind rating system — neither party can see the other's rating until both have submitted. This prevents retaliation and ensures honest feedback.

• A star rating (1–5) is required from both parties upon job completion
• Ratings are submitted independently and remain hidden until both sides have rated
• Once both parties submit, both ratings are revealed at the same time
• If only one party submits, the rating stays hidden and does not count publicly
• Written comments are optional — you may submit a star rating without a comment
• You agree to leave honest and accurate ratings — false or manipulated ratings are prohibited
• GoDayWork reserves the right to remove ratings that violate these terms

9. Content

You retain ownership of content you post (job listings, photos, messages). By posting content, you grant GoDayWork a license to display and use that content to operate the platform. You may not post content that is illegal, offensive, defamatory, or infringes on others' intellectual property rights.

10. Disclaimers

GoDayWork is a marketplace platform that connects hirers and workers. We do not employ workers and are not responsible for:

• The quality, safety, or completion of any job
• Injuries or damages that occur during a job
• Disputes between hirers and workers
• Actions or conduct of any user on or off the platform

Workers are independent contractors, not employees of GoDayWork. Hirers are solely responsible for compliance with applicable labor laws.

11. Limitation of Liability

To the maximum extent permitted by law, GoDayWork shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to lost wages, lost profits, or personal injury. Our total liability to you for any claim shall not exceed the amount you paid in platform fees in the 30 days prior to the claim.

12. Termination

GoDayWork reserves the right to suspend or terminate any account at any time for violation of these Terms, fraudulent activity, providing false identity information, or any other reason at our discretion. You may request deletion of your account by contacting us at [email protected]. Pending payments will be processed before termination. Accounts that are deleted by an administrator cannot be re-registered using the same email address.

13. Changes to Terms

We may update these Terms of Service at any time. We will notify users of material changes by posting a notice on the platform or via email. Your continued use of GoDayWork after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of GoDayWork shall be resolved through binding arbitration, except where prohibited by law.
